Terms & Conditions

These Terms and Conditions ("Agreement") govern the watch repair and restoration services provided by Tukang Warisan ("the Workshop", "we", "us") to clients ("you", "the Client"). By submitting a watch for service, you confirm that you have read and understood these terms.
1. Definitions
- "Service" — any watch repair, maintenance, or restoration work carried out by the Workshop
- "Piece" or "Watch" — the timepiece submitted by the Client
- "Intake" — the moment the Workshop takes physical possession of the piece
- "Scope" — the agreed description of work to be performed, confirmed in writing before service begins
- "Invoice" — the itemised document issued by the Workshop upon completion of service
2. Acceptance of Terms
Submitting a watch in person or by post, or placing a service enquiry that results in an agreed scope, constitutes acceptance of this Agreement. These terms apply to all three service grades: Maintenance Visit, Standard Service, and Conservation Restoration.
You must be at least 18 years of age and have legal authority to authorise service on the submitted piece.
3. Service Description
The Workshop offers three service grades as described on the website and at the bench:
- Maintenance Visit — routine upkeep, battery or winder, gasket, timing check
- Standard Service with Five-Position Regulation — full dismantling, cleaning, lubrication, regulation
- Conservation Restoration — documented restoration for watches of emotional or historical significance
The appropriate service grade is recommended at assessment. The Workshop reserves the right to decline work on pieces where the complexity exceeds our current capabilities, and will advise the Client accordingly.
4. Scope Agreement and Changes
No work begins until the scope and price are confirmed with the Client. If additional work is discovered to be necessary during service, the Workshop will contact the Client before proceeding. Extra costs are incurred only with explicit Client approval. Clients may decline additional work — in which case the piece will be reassembled and returned at the originally agreed service grade price.
5. Pricing and Payment
Service prices are listed in Malaysian Ringgit (RM) and are confirmed in writing before work begins. Payment is due in full upon collection of the piece. The Workshop accepts cash and electronic bank transfer. Invoices must be settled before the piece leaves the premises or before return posting.
Parts required beyond those covered under the standard service scope will be listed separately on the invoice and agreed in advance.
6. Turnaround Times
Estimated turnaround times are given in good faith. The Workshop may extend a turnaround if additional work is discovered or if parts require sourcing. The Client will be informed of any such extension as early as possible. Turnaround times are estimates, not contractual deadlines, unless otherwise agreed in writing.
7. Uncollected Pieces
If a completed piece has not been collected within 90 days of the collection notification, the Workshop will make reasonable further attempts to contact the Client. After 180 days of no response, the Workshop reserves the right to apply storage charges or, in exceptional cases, to act on the piece in accordance with Malaysian unclaimed property conventions. The Workshop will document all contact attempts.
8. Client Responsibilities
- Provide accurate information about the piece and any known history
- Disclose any modifications, prior repairs, or known damage
- Collect the piece within a reasonable time of notification
- Ensure you have the legal right to authorise service on the piece
9. Intellectual Property
All workshop documentation, written methods, photographs, and service record templates created by Tukang Warisan remain the property of the Workshop. Clients retain ownership of all submitted watches and their associated documentation records.
10. Disclaimers
The Workshop provides services with professional care and skill. However, watchmaking involves inherent risks, particularly with aged or fragile pieces. The Workshop does not make representations about results beyond the scope of what is technically achievable with the submitted piece in its presented condition.
Descriptions of work outcomes on the website reflect typical results and are not binding promises as to the outcome of any specific service.
11. Limitation of Liability
The Workshop's liability to any Client in connection with a single service shall not exceed the fee paid for that service, except in cases of gross negligence or wilful misconduct. The Workshop is not liable for pre-existing defects that were not identified at intake, or for damage resulting from defects that were outside the agreed service scope.
Pieces submitted for service are covered by the Workshop's contents insurance while in the Workshop's physical possession. The Workshop is not responsible for loss or damage occurring during transit by third-party couriers unless the Workshop arranged the courier and the damage is attributable to inadequate packing by the Workshop.
12. Conservation Restoration — Special Terms
For Conservation Restoration services, the Client approves the full scope and parts strategy in writing before any work begins. Photographs taken during the restoration are shared with the Client and may, with explicit written permission, be used in the Workshop's portfolio. No restoration photographs are shared publicly without this permission.
13. Governing Law and Disputes
This Agreement is governed by the laws of Malaysia. Any disputes arising from service engagements will first be addressed through direct communication between the Client and the Workshop. If resolution cannot be reached informally, the parties agree to pursue mediation before litigation. The courts of Kuala Lumpur shall have jurisdiction over any unresolved legal disputes.
14. Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full effect. The unenforceable provision will be replaced with the closest enforceable equivalent that reflects the original intent.
15. Changes to These Terms
The Workshop may update these terms from time to time. Updates will be published on the website with a revised effective date. Continued use of the Workshop's services after publication constitutes acceptance of the revised terms.
